GLBA Financial Privacy Notice

FACTS: What does Misc Holdings Ltd. (doing business as NightYield) do with your personal information? Financial companies choose how they share your personal information. This notice explains what we collect, why and with whom we share, and how you can limit some of that sharing.
Why?
Financial companies choose how they share your personal information. Federal law gives consumers the right to limit some — but not all — sharing. Federal law also requires us to tell you how we collect, share, and protect your personal information. Please read this notice carefully.
What?
The types of personal information we collect depend on the product or service you request. This information can include: your name and contact information (email and telephone number); the property and transaction information you enter (such as address or city, price, down payment, property type, projected or actual rental revenue, and credit-score band); and information about your interactions with our Services. We do not collect your Social Security number, account numbers, or credit-card numbers through the Services.
How?
All financial companies need to share customers’ personal information to run their everyday business. In the section below, we list the reasons we can share your personal information, whether we share, and whether you can limit that sharing.
- For our everyday business purposes — to process and respond to your requests, refer your inquiry to lenders you ask to be matched with, maintain records, and comply with law: WE SHARE. Can you limit? NO.
- For our marketing purposes — to offer our products and services to you: WE SHARE. Can you limit? NO.
- For joint marketing with other financial companies: WE DO NOT SHARE for this purpose beyond the partner referrals you authorize.
- For our affiliates’ everyday business purposes — information about your transactions and experiences: WE MAY SHARE with our parent and affiliates. Can you limit? Limited (see below).
- For our affiliates’ everyday business purposes — creditworthiness information: WE DO NOT SHARE.
- For our affiliates to market to you: WE DO NOT SHARE.
- For nonaffiliates to market to you — i.e., the lending/marketing partners you consent to be matched with: WE SHARE only with your consent. Can you limit? YES — do not consent, or opt out.
How to limit our sharing
You can limit sharing where indicated above by not providing consent at our forms, by opting out via Your Privacy Choices or our Do Not Sell or Share page, by replying STOP to texts, or by emailing privacy@nightyield.com. If you are a new customer, we can begin sharing your information from the date you first interact with us; when you are no longer our customer, we continue to share your information as described in this notice. You can contact us at any time to limit our sharing.
Who we are
This notice is provided by Misc Holdings Ltd., a Wyoming for-profit corporation, doing business as NightYield, 228 Park Avenue South, PMB 37100, New York, NY 10003.
What we do — how we protect and collect your information
To protect your personal information from unauthorized access and use, we use security measures that comply with applicable federal law. These measures include computer safeguards (including encryption in transit and at rest), secured files and buildings, and access controls. We collect your personal information, for example, when you use our tools, submit a request to be matched, provide consent, or interact with our Services. We also collect information from service providers that help us operate and that certify your consent.
Definitions
- Affiliates — companies related to us by common ownership or control.
- Nonaffiliates — companies not related by common ownership or control; in our case, the independent lending and marketing partners to whom you consent to be referred.
- Joint marketing — a formal agreement between nonaffiliated financial companies that together market financial products or services. We do not currently engage in joint marketing beyond the partner referrals you authorize.
Other important information
For California and Vermont residents and other jurisdictions with additional restrictions, we will limit sharing as required by applicable law and will not share information about creditworthiness among affiliates or with nonaffiliates for their marketing except as you authorize.
