Why this slips through underwriting more often than you'd expect

DSCR underwriting is mechanical: appraiser or income tool produces a projected or in-place rental figure, that figure divides by the proposed debt payment, and the ratio either clears the lender's minimum or it doesn't. Nowhere in that chain does someone routinely pull the HOA's CC&Rs and confirm short-term rentals are allowed.

That means a loan can close on a property in an HOA that flatly prohibits rentals under 30 days. The lender got their appraisal and their ratio. You got a property you legally can't rent the way you planned to.

What actually happens when the restriction surfaces

  • You can't list the property short-term without violating HOA covenants, which typically exposes you to fines, forced compliance, or in repeat cases, liens.
